NH State Supreme Court Upholds Limited Warrentless Search

Accordingly, we reject the State’s invitation to adopt the federal
automobile exception under the State Constitution. We leave intact the central
holding of Sterndale — that we do not recognize, under Part I, Article 19, the
federal automobile exception as articulated in Ross, 456 U.S. at 825.
Sterndale, 139 N.H. at 449-50.

However, we take this opportunity to recognize a more limited automobile
exception to our warrant requirement. Under that more limited exception, the
police need no warrant to enter an automobile when: (1) the vehicle has been
stopped in transit pursuant to a lawful stop; and (2) the police have probable
cause to believe that a plainly visible item in the vehicle is contraband.

NH Police Investigating (Another Case of) Reported Sexual Assault at Prep School

CONCORD, N.H. (AP) — Police in New Hampshire are investigating reports of a sexual assault at a prep school with a history of sexual misconduct allegations.

FBI agent indicted in Oregon refuge standoff shooting

PORTLAND, Ore.— An FBI agent has been indicted on accusations that he lied about firing at a rancher in 2016 when officers arrested leaders of an armed occupation of a federal wildlife refuge in rural Oregon.

Sources familiar with the case say the agent will face allegations of making a false statement with intent to obstruct justice, The Oregonian/OregonLive reported Tuesday.

The indictment stems from more than a yearlong investigation by the U.S. Justice Department inspector general. The agent will be identified when summoned to appear Wednesday in U.S. District Court in Portland. |More…

If you’re black and angry about the police, your anger is celebrated. If you’re white and angry about the Terror travel ban, the Paris Climate treaty, ObamaCare repeal or any leftist cause, you’re on the side of the angry angels.  …

If you’re an angry leftist, your party leader, Tom Perez will scream and curse into a microphone, and your aspiring presidential candidate, Kirsten Gillibrand, will curse along, to channel the anger of the base. But if you’re an angry conservative, then Trump channeling your anger is “dangerous” because you aren’t allowed to be angry.

Not all anger is created equal. Some anger is privileged rage.

Good anger gets you a gig as a CNN commentator. Bad anger gets you hounded out of your job. Good anger isn’t described as anger at all. Instead it’s linguistically whitewashed as “passionate” or “courageous”. Bad anger however is “worrying” or “dangerous”. Angry left-wing protesters “call out”, angry right-wing protesters “threaten”. The co-owner of a dockside Baltimore restaurant has revealed that nearly his entire kitchen staff resigned after an Immigration and Customs Enforcement agent demanded their papers in the latest example of the national debate over immigration.

Bill to study better ways to resolve Right-to-Know complaints signed into Law

Governor Sununu signed HB178 into law on June 16th.  This bill establishes a 13 member study commission on resolving Right-to-Know complaints.

Should a citizen feel the Right-to-Know law has been violated, currently, enforcement of the law falls squarely on the citizen’s shoulders.  Costs and legal complexities associated with filing a petition in court is a financial and emotional burden, and for some, it’s simply prohibitive.   Additional costs are also born by public bodies and the courts.  Regardless of who wins or loses the lawsuit, the taxpayer is burdened with a great deal of the total expense.  To reduce these costs to the taxpayers, this commission will study ways to reduce both the number of and the expense of resolving complaints consistent with the following: |More…
